THAT'S THE PROCESS THAT SUPERINTENDENT CHAPMAN WAS TALKING ABOUT, THE RFP PROCESS. THE DEADLINE FOR THAT END OF THIS MONTH, THE 28TH OF FEBRUARY. WE WORK WITH CONSULTANTS TO GET THAT PAPERWORK AND ALL FILED IN. ONCE THAT'S FILED IN, THERE'S A 28-DAY WINDOW WHEN THAT REQUEST FOR SERVICES IS PUT OUT THERE, AND THEN WE HAVE VENDORS RESPOND TO THAT. OBVIOUSLY, K12ITC IS GOING TO BID FOR THAT. THE PART THAT SEEMS TO BE WORKING PRETTY WELL NOW IS THAT FIRST PART OF THE NETWORK INFRASTRUCTURE THAT IRONED OUT THE WRINKLES THERE. BUT IF WE WERE TO RENEW OUR CONTRACT WITH THEM FOR ANOTHER FIVE YEARS, THEY WOULD IN FACT PULL ALL OF THAT EQUIPMENT OUT AND PUT NEW IN. IF WE WERE TO GO WITH ANOTHER VENDOR, IT'D BE THE SAME PROCESS. WE'RE LOOKING AT THAT EITHER WAY, WHETHER WE STAY WITH K12 OR NOT. THEN THE OTHER PART, LIKE THE CHROME BROWSER AND THE DEVICE MANAGEMENT AND END USER SUPPORT, THAT IS A VERY DIFFICULT THING THAT THEY'RE TRYING TO DO. TECH TAKES A LOT OF CLOSE COORDINATION IN ORDER TO GET IT RIGHT. IT DOES MAKE SENSE TO FARM THAT OUT BECAUSE IT CAN BE DONE REMOTELY, IT CAN'T BE MANAGED, AND THERE'S VISIBILITY ON THOSE SYSTEMS. THERE ARE SOME THINGS THAT ARE MORE COMPLICATED AND REQUIRE REALLY SOMEONE ON SITE, SOMEONE THAT'S FAMILIAR WITH THE ENVIRONMENT, FAMILIAR WITH THE TEACHER, UNDERSTANDS WHAT THEY'RE SAYING, WHAT THEY'RE GETTING AT, AND CAN HANDLE THAT SITUATION MORE EFFICIENTLY. WHEN THE ONLY OPTION IS TO CALL AN 800 NUMBER, THAT BECOMES DIFFICULT AND THEN WHEN THOSE TICKETS GET DRAWN OUT, THEY SOMETIMES DO GET PUSHED BACK TO THE LOCAL TEXT. WE DID LOSE A COUPLE TEXTS WHEN K12ITC CAME IN, LIKE THREE OF OUR TECHS HAVE LEFT SINCE WE HAD K12. WE ARE DOWN TO A SMALLER STAFF. WE ARE IN A DIFFICULT POSITIONS IN SOME WAYS BECAUSE WE HAVE A SMALL NUMBER OF PEOPLE AND K12ITC IS REALLY ON CONTRACT TO HANDLE THESE ISSUES, BUT A LOT OF THOSE DO COME BACK OUR WAY JUST BECAUSE IT'S EASIER FOR US TO DEAL WITH IT. I DON'T KNOW IF THAT ANSWERS THE QUESTION, BUT AS FAR AS HOLDING THEIR FEET TO THE FIRE, REALLY THE MOST RESPONSIVE THAT THEY'VE BEEN OR THE MOST ADAPTABLE THAT THEY'VE BEEN WORKING WITH US IN THE CONTRACT IS RIGHT AROUND THE RENEWAL TIME OF THE CONTRACT. WE HAVE LOTS OF SUGGESTIONS. I HAVE A SPEECH THAT I GIVE, A COUPLE OF SPEECHES, BUT IT'S VERY DIFFICULT FOR THEM IN THEIR BUSINESS MODEL TO DO A CUSTOM SOLUTION, WHICH IS WHAT WE REQUIRE IN A LOT OF CASES. FOR THEM, EFFICIENCY MEANS SAME THING FOR ALL SCHOOL DISTRICT AND THAT DOESN'T ALWAYS WORK FOR WHAT WE'VE GOT GOING ON HERE. FOR EXAMPLE, WE HAVE A MAC DEPLOYMENT WITH IPADS AND MACS ALMOST EXCLUSIVELY, JUST 99% ON THOSE PLATFORMS. THAT'S NOT THE CASE EVERYWHERE ELSE IN OUR OTHER CUSTOMER BASE. IT REQUIRES A LITTLE MORE EXPERTISE IN THAT DEPARTMENT, WHICH ISN'T ALWAYS EFFICIENT FOR THEM BECAUSE THEY DON'T HAVE A BUNCH OF CUSTOMERS THAT ARE RUNNING THAT SET UP. [00:15:02] THAT MAKES SENSE. THE THREE MAIN OPTIONS THAT WE HAVE IS TO CONTINUE TO RUN OUR FOOD SERVICE DEPARTMENT AS IS AS A DEFICIT, AND MOVE MONEY FROM THE GENERAL FUND INTO THE FOOD SERVICE ENTERPRISE FUND, AND RELY ON THE DONATIONS FROM THE FUND FOR PUBLIC EDUCATION. WE COULD GO OUT FOR BID AND CONTRACT OUR FOOD SERVICE, WHICH MAY OR MAY NOT BE A VIABLE OPTION. WE ARE PREPARING AN RFP RIGHT NOW. WE HAD A REALLY HEALTHY CONVERSATION IN [INAUDIBLE] SO MY MIND HAS BEEN SPINNING EVER SINCE THEN. BUT THERE'S A COUPLE OF DISTRICTS THAT DON'T PARTICIPATE IN THE NATIONAL SCHOOL LUNCH PROGRAM, WHICH MEANS THEY'RE NOT GETTING THAT FEDERAL REIMBURSEMENT. BUT THERE'S A COUPLE IN THIS STATE THAT ARE REALLY SUCCESSFUL AT MANAGING THEIR FOOD SERVICE WITHOUT A DEFICIT, WITHOUT THAT REIMBURSEMENT. THEY'RE ABLE TO ELIMINATE SOME OF THE RESTRICTIONS THAT WE HAVE. SOME OF THE GUIDELINES FOR PREPARING FOOD FROM THE USDA SOMETIMES PRESENTS AS EATING CARDBOARD. IF WE ELIMINATE THOSE RESTRICTIONS AND FOCUS MORE ON A HEALTHY FOOD PROGRAM, WHICH I THINK WE COULD REALLY GET A LOT OF INTEREST FROM OUR LOCAL FOOD COLLABORATORS, WE MAY BE ABLE TO MANAGE A PROGRAM LIKE THAT A BIT DIFFERENTLY. THEY ARE TAKING COMMENT FOR A HEARING THAT WILL COMMENCE ON FEBRUARY 21 REGARDING DRAFT AMENDMENTS TO THE LAND DEVELOPMENT REGULATIONS. WE HAD A CLARIFYING MEETING WHERE IT WAS BROUGHT FORWARD THAT IN THESE DRAFT AMENDMENTS THAT ARE BEING CONSIDERED FOR NORTHERN SOUTH PARK AREA 1, SPECIFICALLY THAT IT IS CALLED OUT THAT 0.01 EXACTION WOULD BE PER ACRE OR UNIT FOR BOTH RESTRICTED AND UNRESTRICTED DEVELOPMENT. IN CONSIDERING NORTHERN SOUTH PARK AREA 1 THAT WOULD GENERATE SIX ACRES FOR FUTURE SCHOOL SITE. THAT, COMBINED WITH THE 12 ACRES FOR A PART, WOULD CERTAINLY BE ADEQUATE FOR A FUTURE ELEMENTARY SCHOOL SITE. IT WAS SUGGESTED THAT WE CLARIFY OUR POSITION, AND WHILE THE BOARD, IN THE PAST, HASN'T TAKEN A POSITION IN FAVOR OR IN OPPOSITION TO A SPECIFIC DEVELOPMENT, OUR INTEREST HAS BEEN MORE CENTERED AROUND ENSURING THAT WITH THESE LARGE SCALE DEVELOPMENTS IN THE FUTURE THAT A SET ASIDE IS DONE, AND IT'S SPECIFICALLY CALLED OUT. THIS LETTER ATTEMPTS TO SAY WE'RE NOT SUPPORTING OR OPPOSING ANY PARTICULAR DEVELOPMENT. WHAT WE'RE SAYING IS WE'D LIKE TO HAVE AN EXACTION IN LAND AND WE'D LIKE TO KNOW THAT THAT IS SET ASIDE. SO THESE DRAFT AMENDMENTS THAT THE BOARD OF COUNTY COMMISSIONERS WILL BE CONSIDERING BEGINNING FEBRUARY 21, BASICALLY SAYS, IF THIS IS INDEED TRUE, SIX ACRES WOULD BE ADEQUATE BECAUSE WE CAN PUT THAT NEXT TO A PARK AND REALLY MAKE GOOD USE OF THE PROPERTY FOR A FUTURE SITE. THE OTHER SUGGESTION IN HERE IS THAT, TO BE SPECIFIC, WITH THOSE AMENDMENTS TO THE LAND DEVELOPMENT REGULATIONS, IT IS ABUNDANTLY CLEAR THAT THE EXACTIONS PER UNIT AND THE DRAFT AMENDMENTS ARE EXACTLY AS THEY'RE SAID SO THAT DOWN THE ROAD THERE ISN'T ANY AMBIGUITY OR QUESTION ABOUT THE IMPACT OF SCHOOLS. I THINK IF THIS INFORMATION WAS BROUGHT FORWARD YEARS AGO, WE WOULDN'T HAVE HAD ANY CONCERNS WHATSOEVER. I APPRECIATE THE FACT THAT THE COMMISSIONERS ARE LOOKING AT THIS, I JUST THINK IT NEEDS TO BE SPECIFICALLY CALLED OUT. WE'RE HOPEFUL THAT THIS CLARIFIES WHERE WE STAND ON NORTHERN SOUTH PARK AREA 1. THEN THERE'S ANOTHER SECTION IN THERE THAT REITERATES THAT OUR CONCERN RIGHT NOW IS THE FUNDING FOR THE ADDITION TO THE HIGH SCHOOL. THAT IS A CRITICAL NEED. THEN IT REFERENCES IN THE LETTER THAT WAS DRAFTED PREVIOUSLY, I HAD A TYPO IN THERE AND IT SAID THE ROOFTOP MULTIPLIER WAS 0.03, IT'S 0.3 PER ROOFTOP SO THIS CLEARS THAT UP AS WELL. I BELIEVE THE READERS UNDERSTOOD THE INTENT AND I APPRECIATED THEM CALLING IT TO MY ATTENTION THAT THERE WAS AN ERROR. THE AGREEMENT IS A COMPREHENSIVE USE AGREEMENT [01:10:04] BETWEEN THE PARTIES BEING THE SCHOOL DISTRICT, TETON COUNTY, AND THE TOWN OF JACKSON. THE COUNTY IN THE TOWN ARE INVOLVED BECAUSE THEY TOGETHER FORM THE JACKSON TETON COUNTY PUBLIC FACILITIES JOINT POWERS BOARD. WHEN WE REVIEW THE PARKS AND REC, THERE IS A DEPARTMENT OF PARKS AND RECREATION GOVERNED BY THE JOINT POWERS BOARD. THERE'S MULTIPLE LEVELS. IT'S AN AGREEMENT THAT WE'VE NEGOTIATED WITH THE TOWN, THE COUNTY, LARGE INPUT FROM PARKS AND REC AND THE BOARD ITSELF, IF NECESSARY. WHAT THE AGREEMENTS HISTORICALLY HAVE COVERED ARE LAND EXCHANGES. THERE IS A HISTORY OF LAND EXCHANGES, BUT PRIMARILY THE COOPERATIVE USE BETWEEN PARKS AND REC AND THE SCHOOL DISTRICT REGARDING THE CONSTRUCTION, USE, MAINTENANCE, SCHEDULING OF THE FIELDS AND FACILITIES, WHICH ARE PART OF THE AGREEMENT, AND I'LL SHOW YOU IN JUST A BIT THERE ARE ONLY CERTAIN FIELDS AND FACILITIES OWNED BY TETON COUNTY SCHOOL DISTRICT THAT ARE PART OF THE AGREEMENT. THERE ARE SPECIFIC FIELD AND FACILITIES THAT ARE EXCLUDED. AS FAR AS THE PURPOSE IN THE INTENT, I THOUGHT I PULLED THE LANGUAGE DIRECTLY FROM SOME OF THE HISTORICAL AGREEMENTS, BUT THE ONGOING THEME THROUGHOUT THE AGREEMENTS HAS BEEN THAT IT REALLY IS IN THE BEST INTEREST OF THE TAXPAYERS NOT TO HAVE DUPLICATIVE SERVICES AND EXPENDITURES IN PROVIDING RECREATIONAL FIELDS AND FACILITIES. CHAPMAN JUST REFERENCED THAT IN SAYING, THERE'S A SCHOOL SITE, IT'S IDEAL TO HAVE A PARK RIGHT NEXT DOOR BECAUSE IT CAN BE USED BY COMMUNITY, IT CAN BE USED BY THE SCHOOL STUDENTS, AND THEN AGAIN, IT HAS MULTIPLE USES. AGAIN, FROM THE DISTRICT'S PERSPECTIVE, OUR RECITAL STATES THE DISTRICT HAS ALLOWED COMMUNITY USE OF THE FIELDS AND FACILITIES FOR RECREATIONAL PURPOSES, AND AGAIN, IN EXCHANGE FOR A WHOLE HISTORY AND ONGOING CONSTRUCTION, MAINTENANCE, REPAIRS TO FIELDS AND FACILITIES, AND AGAIN FOR COMMUNITY USE IS THE OVERALL THEME. IN 1998, WAS THE ORIGINAL POOL USE AGREEMENT. THIS IS WHAT REALLY WAS THE GENESIS OF WHAT THE CURRENT COMPREHENSIVE USE AGREEMENT IS TODAY. BUT JUST FOR HISTORICAL REFERENCE, IN 1993, THE SCHOOL DISTRICT TRANSFERRED A PORTION OF THE PROPERTY ON WHICH NOW THE RECREATION CENTER SETS TO THE TOWN INITIALLY, BUT ULTIMATELY TO THE JOINT POWERS BOARD AND THE INTENT, THERE WAS REALLY A COLLABORATIVE EFFORT TO GET A RECREATION CENTER CONSTRUCTED. AGAIN, THE INTEREST OF THE SCHOOL WAS SO THAT SCHOOL STUDENTS HAD ACCESS TO A POOL, AND AGAIN, ACCESS TO THE POOL FOR SWIM TEAM PURPOSES. THAT GOES BACK AS FAR AS 1993. AN ENTIRELY ANOTHER SEPARATE AGREEMENT WAS IN 1999 AGREEMENT REGARDING THE SKATEBOARD PARK. DO YOU KNOW HOW THAT WAS CONSTRUCTED? I BELIEVE THAT FUNDS OR SOME FUNDING, BUT AGAIN, NOT FUNDING COMING FROM THE SCHOOL DISTRICT YET. I THINK ALL THE PARTIES INVOLVED THOUGHT IDEALLY, THE LOCATION WHERE IT CURRENTLY IS IS A PERFECT LOCATION FOR A SKATE PARK. SO THAT WAS A SEPARATE AGREEMENT AND THEN IT WASN'T UNTIL 2009 WHERE THE PARTY SAT DOWN AND DECIDED THERE'S ALL THESE HISTORICAL AGREEMENTS, LET'S GET THEM ALL IN ONE PLACE AND TRY REALLY WORK OUT HOW THIS IS ALL GOING TO WORK. BECAUSE I THINK BEFORE THEN THERE WERE JUST TOO MANY AGREEMENTS, SOME WERE EXPIRING, SOME WERE NOT NEEDED ANY LONGER. SO WE REALLY TRIED TO DRAFT AND IMPLEMENT [01:15:02] A COMPREHENSIVE AGREEMENT INVOLVING ALL THE FIELDS AND FACILITIES THAT ARE AT ISSUE. AGAIN, THAT WAS AMENDED IN 2012, SO 2013 A WHOLE NEW AGREEMENT WAS PUT IN PLACE, AND THEN MOST RECENTLY IN 2022 IS WHAT THE CURRENT COMPREHENSIVE AGREEMENT THAT WE HAVE IN PLACE TODAY. THANK YOU. THE INTENT OF THE 2022 AGREEMENT WAS, AGAIN, A WHOLE LOOK AT ALL THE AGREEMENTS IN PLACE, WHAT'S WORKING, WHAT'S NOT WORKING. DR. CHAPMAN WAS REALLY INVOLVED DEEPLY AND SUCCESSFULLY IN CHANGING HOW THE ENTIRE AGREEMENT OPERATED. OVER THE YEARS, I DON'T KNOW IF IT HAD MUCH SUCCESS IN SOME ISSUES, SCHEDULING HAS ALWAYS BEEN A BIG ISSUE. MAINTENANCE, I THINK NOT AS BIG AN ISSUE, BUT SCHEDULING WAS ALWAYS A BIG ONE.THEN AGAIN, PRIORITY OF USE BECAUSE THAT'S VERY IMPORTANT TO THE DISTRICT FOR EXAMPLES. THEN NUMBER 4, YOU'LL SEE WHICH WE CAN DISCUSS A LITTLE BIT IS SERVICE LEVELS WITH ALL PARTIES JOINTLY MAINTAINING AND USING. A SIGNIFICANT ISSUE FOR THE SCHOOL DISTRICT IS A PRIORITY OF USE AND THAT'S VERY CLEARLY SPELLED OUT, PER FIELD, PER FACILITY, SO THAT THE DISTRICT CAN ENSURE THAT IT HAS ALWAYS PRIORITY USE WHEN IT'S NEEDED. BECAUSE AGAIN, THESE ARE FIELDS AND FACILITIES OWNED BY THE DISTRICT. AGAIN, NUMBER 4 WAS SERVICE LEVELS. DR. THOUGH AGAIN, IF THERE WAS COMMUNITY USE NEEDED OF THOSE ON THE RIGHT, THEY SIMPLY COULD ASK UNDER THE RENTAL AGREEMENTS TO USE THOSE FIELDS. AGAIN, NOT BEING ABLE TO GO BACK BEFORE THIS AGREEMENT, I'LL PICK ON THIS AGREEMENT A BIT BECAUSE TO THE BEST OF MY KNOWLEDGE, THE SCHOOL DISTRICT MISSED THEIR SCHEDULE SUBMISSION DATE, WHICH REALLY LED TO THE POOL BEING CLOSED IN THE MIDDLE OF THE SWIM SEASON. BECAUSE THERE'S A PRIORITY OF USE, AND THERE'S A DEMAND FOR SCHEDULE SUBMISSION. SO I DON'T KNOW IF THERE'S ANY SUMMER USE, BUT THAT WAS SUPPOSED TO HAPPEN IN FEBRUARY 1 FOR ANY SCHOOL DISTRICT NEEDS AT THE POOL THIS SUMMER. SO THOSE ARE ALL LAID OUT. AND THEN TWO THINGS THAT I THINK WERE MISSED OR MAYBE THAT I DIDN'T HEAR. THE FEES YOU'RE PAYING TO USE THAT POOL, THE SWIM TEAM AND THE LETTERING SWIM PROGRAM ARE UNJUST. THEY'RE NOT IN THE AGREEMENT. TO THE BEST OF MY KNOWLEDGE, YOU'RE PAYING PER SWIMMER. IT'S EXPLICITLY LAID OUT IN THERE. YOU ARE SPLITTING THEIR COST FOR LIFEGUARDS. RIGHT NOW, IF YOU LOOK, AND I THINK YOU'LL FIND THAT THERE'S A LOT OF OTHER CHARGES YOU'RE PAYING THAT AREN'T NECESSARY. ALSO, THERE IS A POSSIBILITY OF TERMINATING THAT AGREEMENT EARLIER FOR BREACH. THERE'S A BREACH CLAUSE IN THERE AND HOW YOU TERMINATE IT. AND I KNOW LAST TIME WE TALKED THAT THEY MIGHT NOT BE INTERESTED IN OPENING THIS AGREEMENT, BUT I REALLY THINK THE BIG GORILLA IN THIS ROOM, AND THAT GORILLA DOESN'T HAVE A SWIM CAP ON BECAUSE IT'S MECHANICAL, IS THERE IS LITERALLY 15 TO $20 MILLION IN IMPROVEMENTS NECESSARY FROM THE PARKS AND REC DIRECTOR BEFORE 2030. THEY'RE NOT PLANNING FOR THAT. THE SPET IS NOT READY FOR THIS. IT'S ALL BACKED. AND SO AGAIN, WHEN I FEEL THAT I DON'T NEED TO COME HERE ANYMORE, I'M GOING TO GO THERE AND START PICKING ON THEM BECAUSE THAT'S A LOT OF MONEY IN A SHORT PERIOD OF TIME WITH NO PLAN. BECAUSE I'M HEARING ABOUT THE GROWTH, I'M HEARING ABOUT HOUSING, I'M HEARING ABOUT HOW PROACTIVE YOU GUYS ARE, AND I'M SEEING ALL THE HURDLES AND POTHOLES YOU GUYS ARE CHALLENGED WITH. IT'S NOT EASY, NOTHING'S EASY. AND OVER THERE, IT'S GOING TO BE ALL ABOUT THE GLORY OF AN OPULENT ROCK GYM, AND IT'S NOT GOING TO BE FOR THE POOL. AND AT THE END OF THE DAY, EVEN IF THAT POOL IS RUNNING, IT'S STILL ONLY ONE POOL FOR THIS WHOLE COMMUNITY. SO I DON'T CARE IF IT PRIORITIZE KIDS OVER ADULTS BUT THEN SCHOOL KIDS HAVE THE PRIORITY, IT'S NOT ENOUGH FOR THIS VALLEY. AND I DON'T WANT TO PUT THAT ALL ON YOU GUYS, BUT AGAIN, THAT'S THE ONLY ONE AND I THINK IT NEEDS TO BE PROTECTED. AND SO THE BIGGEST NEED TO OPEN UP THAT AGREEMENT, BECAUSE MAYBE THE SOFTBALL, GIRLS VARSITY SOFTBALL IS GOING TO MAKE A DEMAND TO OPEN IT UP, IS GET A LEVEL OF SERVICE FOR THE POOL. IF THAT'S THE ONLY PART OF THAT WHOLE AGREEMENT, DOESN'T HAVE A LEVEL OF SERVICE, IS PROBABLY THE ONE THAT NEEDS THE MOST DEFINED LEVEL OF SERVICE. AGAIN, THANKS FOR HAVING ME. IT WAS IMPRESSIVE. THEY COVERED ALL BASIS, AND HOPEFULLY WE'LL BE ABLE TO SECURE SOME FUNDING AND REALIZE THIS GOAL FOR THE STUDENTS NEXT YEAR.
